Welcome to federicosibella.com (the “Website”), owned and operated by Federico Maria Sibella, registered office at Strada Giardina 24, 12040, Priocca (CN) - Italy, VAT 03898270040, contact e‑mail federico.maria.sibella@gmail.com (the “Owner”). Accessing the Website and/or purchasing products or services implies full acceptance of these terms and conditions (the “Terms”).
1) Definitions
User: anyone browsing the Website.
Customer/Consumer: a natural person purchasing on the Website for purposes outside their trade or profession.
Professional: a natural or legal person purchasing for professional purposes.
Services: activities provided by the Owner (e.g., 1‑to‑1 sessions, mentorship, courses, workshops, consulting, subscriptions).
Digital Products: downloadable files, on‑demand content, educational materials, presets, templates.
Shop: the e‑commerce area of the Website.
2) Scope
These Terms govern: (i) use of the Website; (ii) sale of Digital Products; (iii) provision of Services, including training delivered in person and/or online.
3) Eligibility and Accounts
3.1 The User declares to be at least 18 years old and legally capable.
3.2 [If an account is required] Account creation is personal and non‑transferable; credentials must be kept secure. The Owner may suspend or terminate accounts in case of a breach of these Terms.
4) Pre‑contractual Information
Before checkout, the Customer receives clear information on price, taxes/VAT, main characteristics of the good/service, payment methods, delivery/performance, and right of withdrawal (where applicable).
5) Prices, Currencies, and Invoicing
5.1 Prices are shown in EUR and, unless otherwise stated, include VAT.
5.2 Where applicable, VAT is calculated per current law and the Customer’s location (e.g., EU rules on electronically supplied services; MOSS/OSS).
5.3 Invoices are issued upon request [or automatically] using the data provided by the Customer, who warrants their accuracy.
5.4 Promotions/discounts are subject to terms and availability.
6) Payments and Security
6.1 Payments are processed via payment processors (e.g., Stripe/PayPal/Bank Transfer). The Owner does not store card details.
6.2 If payment fails, the order is not completed. In case of chargeback or suspected fraud, the Owner may suspend access and take protective actions.
6.3 Any installments/subscriptions will be charged according to the frequency shown at purchase.
7) Delivery/Performance
7.1 Digital Products: immediate access or via link sent to the Customer’s e‑mail / reserved area.
7.2 Services/Training: delivered on the dates/times agreed via calendar or e‑mail. Any technical prerequisites (software, connection, mic/camera) are the Customer’s responsibility.
7.3 Subscriptions/Platforms: access remains valid for the stated period (e.g., “12 months,” “ongoing while the subscription is active”). The Owner may perform scheduled maintenance, causing reasonable service interruptions.
8) Right of Withdrawal and Refunds
Free Trial Hour (Included in Each New Engagement)
Each paid session/package includes a 60‑minute free trial at the beginning of the engagement. The free trial is already part of the purchase and is intended to let Customers assess the fit, teaching style, and session scope before committing further. After the free trial concludes, continuation of the session or commencement of the package constitutes acceptance of the service and triggers the refund rules below.
EU Consumers
Services: the Customer has 14 days to withdraw from a distance contract. Exception: if the Customer requests performance before the 14‑day period and the service is fully performed, the right of withdrawal no longer applies; if partially performed, a proportional amount is due.
Digital Products: the right of withdrawal is excluded once the download/streaming has started or access has been unlocked, subject to the Customer’s express consent and acknowledgment of losing the right (Art. 16/59 EU Consumer rules).
Live courses / 1‑to‑1 sessions: unless otherwise stated, cancellations up to 1 hours before the appointment = rescheduling; beyond that, no refund or rescheduling.
Refund Policy After the Free Trial
Once the free trial has ended and the Customer elects to proceed (e.g., completes the session, continues the package, or consumes additional time), refunds are limited. Full refunds will be considered only in the following specific situations:
Duplicate payment/accidental double purchase (unaccessed duplicate), verifiable and notified promptly.
Fraudulent charge proven via the payment processor’s dispute process.
Technical failure attributable to the Owner that prevents delivery of the service and is not remedied within a reasonable timeframe after the Customer’s notice.
Statutory right of withdrawal, where applicable, and before service performance begins beyond the free trial.
In all other cases, refunds will be partial (pro‑rata) or not available, depending on the portion of service already delivered and the specific cancellation timing. Where partial refunds apply, any non‑refundable payment processor fees and used time will be deducted.
Refund Method
Requests must be sent to federico.maria.sibella@gmail.com, indicating order number, product/service, and reason. Refunds are issued to the original payment method, net of non‑refundable processor fees, within reasonable processing times.
9) Licenses and Intellectual Property
9.1 All Website content, Digital Products, and training materials (texts, images, videos, presets, code, slides) are protected by copyright.
9.2 Unless otherwise licensed in writing, purchase grants a personal, non‑exclusive, non‑transferable, non‑sublicensable license for private use only.
9.3 Prohibited: unauthorized public/private sharing, resale, republication, reverse engineering, or extraction of components to build competing products.
9.4 Recordings: [Recording of sessions/coaching is prohibited and distribution of replays is forbidden without prior written consent / Recordings may be provided for personal use only.
10) User Conduct
The User agrees not to: (i) violate laws or third‑party rights; (ii) upload unlawful, defamatory, discriminatory, or harmful content; (iii) attempt unauthorized access; (iv) interfere with Website security; (v) use materials contrary to the granted license.
11) Feedback and User‑Generated Content (UGC)
By sharing feedback, testimonials, or UGC, the User grants the Owner a non‑exclusive, worldwide, royalty‑free license to use, reproduce, and communicate such content for promotional purposes, in line with the Privacy Policy. The User warrants that they hold the rights to what they submit.
12) Third‑Party Tools
The Website may integrate third‑party services (e.g., payment gateways, e‑learning platforms, newsletters). Use is also subject to those third parties’ terms. The Owner is not liable for malfunctions attributable to external providers.
13) Disclaimers
Except as required by law, services and content are provided “as is” and “as available,” without implied warranties of fitness for a particular purpose or guaranteed results. Information provided during training/consulting is educational and does not constitute personalized professional advice unless expressly agreed.
14) Limitation of Liability
To the extent permitted by law, the Owner shall not be liable for: (i) indirect, incidental, consequential damages; (ii) loss of profits, data, or opportunities; (iii) service interruptions not due to willful misconduct or gross negligence. In any event, total liability to the Customer shall not exceed the amount actually paid for the good/service giving rise to the claim.
15) Indemnity
The Customer shall indemnify and hold the Owner harmless from third‑party claims arising from unlawful or non‑compliant use of the Website, materials, or purchased content.
16) Force Majeure
The Owner is not responsible for delays or failures due to causes beyond reasonable control (e.g., large‑scale network outages, blackouts, natural events, acts of authorities, third‑party strikes).
17) Changes to the Terms
The Owner may amend these Terms at any time. Changes apply to sales concluded after publication. For ongoing services/subscriptions, the Customer will be notified 1 week in advance and may terminate without penalties before the effective date.
18) Privacy and Cookies

19) Dispute Resolution – ODR

These Terms are governed by Italian law. Any dispute shall be submitted to the exclusive jurisdiction of the Court of Asti [for Consumers: the court of the Consumer’s place of residence or domicile].
